Changes to Functional Abilities Form

The Union became aware of unilateral changes to a medical form that in some circumstances must be filled out.  It is called a “Functionable Abilities Form” (FAF). This document is used to assess an employee’s physical and functional abilities, often in relation to a return to work after an illness or injury. Air Canada has changed this form without notifying the Union. We have consulted with legal counsel and have concerns with various elements of the form. Specifically, it exceeds what is necessary for the employer to accommodate employees and infringes on employees’ rights under both the Collective Agreement and Canadian Privacy legislation.
