GRIEVANCE NUMBER: CHQ-14-41 (POLICY)SUBJECT: Special Assignment Failure to Publish
DEPARTMENT: Mr. Harlan Clarke, Director, Air Canada Labour Relations – IFSNATURE OF THE GRIEVANCE:
The Union claims that Air Canada violated the Collective Agreement and is filing a Policy Grievance. Specifically, Air Canada selected Cabin Personnel for special assignments without publishing or advertising the assignments as required by L5.01 of the Collective Agreement. Air Canada’s failure to post these positions also resulted in a failure to consider applications, as also required by L5.01.
We submit this grievance under articles/clauses 13, L5.01, and any other related act, article or statute, and past practice and all other pertinent sections of the Collective Agreement.
SETTLEMENT REQUESTED: The Union hereby requests:

  1. A declaration of breach;
  2. An order to cease and desist breaches of LOU 5;
  3. An order that all affected employees be made whole and damages be paid to the Union; and
  4. Any other relief deemed appropriate by the Arbitrator.

We request a hearing on an expedited basis, and the Company provide all documentation relied upon in this matter.
