Rouge Policy Grievance – Substantiation Requests for Book Offs of Less than Five (5) Days

For Rouge Employees Only

Dear Rouge Members,

It has come to the Union’s attention that members are being asked for medical notes for absences of less than five (5) days which is contrary to L55.11.03 as well as section 239(2) of the Canada Labour Code that states, “If a medical leave of absence (paid or unpaid) is 5 days or longer, your employer may require that you provide a certificate issued by a health care practitioner.”.

We have filed the following policy grievance linked HERE.

At Mainline, the following grievances regarding sick leave were filed and are set to be heard at arbitration on October 17, 2025.
– CHQ-23-38 – POLICY – Sick Leave Substantiation Requests – Five (5) days or more
– CHQ-23-41 – POLICY – Canada Labour Code Violation – Ten (10) Day Time Limit to Provide Medical Substantiation
– CHQ-23-42 – POLICY – Violation of Article 9 (Improper Calculation of Sick Leave When Requesting Sick Leave Medical Substantiation)
– CHQ-24-18 – POLICY – Canada Labour Code Paid Medical Leave (sections 239)

Please send your examples to your Rouge Local Office at contact@cupe4098.ca to help support our policy grievance.

In Solidarity,

Wesley Lesosky
