DAYS SINCE WE BEGAN THE BARGAINING PROCESS. WE ARE UNITED AND WE WILL MAKE CHANGE.

Your Health Benefits – Physiotherapy and Athletic Therapy

As many of you are aware, coming out of bargaining the Union has raised many issues that the Company has, in our opinion, re-interpreted to their advantage, and as you know we have grieved.

The grievance process takes time.

Yesterday the Union concluded their monthly review with Chief Arbitrator William Kaplan and CHQ-25-134 the Physiotherapy Benefits grievance was mediated.

Our Collective Agreement provides coverage for physiotherapy, subject to an annual maximum of $4,000.

It also provides coverage for athletic therapy, which is not subject to an annual maximum under the Collective Agreement.

The distinction is significant. The $4,000 annual maximum applies specifically to physiotherapy benefits. The language of the Collective Agreement is clear:

22.02.04: Coverage will be provided for the services of a registered/licensed physiotherapist up to a maximum of four thousand dollars ($4,000) per calendar year.

In other words, physiotherapy and athletic therapy are separate benefits under the Collective Agreement. The $4,000 cap on physiotherapy does not create a $4,000 cap on athletic therapy.

The Company maintained a position that was not discussed, alluded to or changed in bargaining, and now we have no other means than to file for arbitration.

What this means for you
The two benefits should not be treated as one combined $4,000 limit. If you have questions about your coverage or a claim has been denied on this basis, please contact the Union via email at i.jovic@accomponent.ca.

We will continue to enforce the collective agreement and update you as we move through this process.

In solidarity,

Wesley Lesosky
President, Air Canada Component of CUPE
