As you may recall, the union’s policy grievances proceeded to arbitration before Chief Arbitrator William Kaplan regarding the OBSM program and the union was largely successful. Further to the Chief Arbitrator’s direction to determine the individual demotions separately, the union proceeded to arbitrate the individual grievances filed by the union concerning the demotion of service directors via the OBSM program. The individual grievances were all upheld and the Chief Arbitrator found that the demotions were not justified and were “excessive”. The Chief Arbitrator rescinded all of the demotions and ordered that the grievors be compensated for their losses.
