Local 4092 Trustee Vacancy Election

THIS BULLETIN PERTAINS TO LOCAL 4092 MEMBERS ONLY

This is to advise that nominations took place, at the Local 4092 general membership meeting which was held on September 22, 2022, to fill the one vacant Local 4092 Trustee position, for the remainder of the term ending on March 31, 2025. The following members were nominated:

In accordance with Air Canada Component Bylaw C.8.3, an election must be held. Voting for this position will begin on January 23, 2023 at 9:00 am EST, and end on February 1, 2023 at 12:00 pm EST.

IMPORTANT, PLEASE READ CAREFULLY: You will receive a letter by email, and by regular mail for those that did not opt out of physical mailings, directly from Simply Voting prior to the vote opening. This letter will contain a new Elector ID and Password, along with detailed instructions on how to vote online and by telephone.

You have the option of voting by web, or by phone, as per Component Bylaws. You will need your new Elector ID and Password to access the system.

Once you have submitted your vote, the Simply Voting system will issue a printable electronic receipt. If you are voting by phone, you can only access your electronic receipt by logging into the Simply Voting system online.

Arbitration Award – Individual/group grievances dismissed by Arbitrator

In grievances filed between 2017 and 2019 (YYZ-SG-17-69, YVR-17-118, YYZ-SG-18-11, and YYZ-SG-19-47) the Union alleged that Air Canada did not provide appropriate crew rest at layover stations after short-range flight legs that were added to long-range extension pairings after departure.  In these cases, the short-range flight legs were added in two circumstances: to reserve pairings, and to regular pairings in which flights were diverted.

The Union’s position was that Air Canada must provide long-range crew rest of 18-24 hours after each flight leg in a pairing scheduled under the Collective Agreement’s long-range extension provisions (Articles B14, L18, and L22), including after short-range flight legs later added to the pairing.

Unfortunately, Chief Arbitrator Kaplan dismissed the Union’s grievances.  Click HERE to view the award.  Although such pairings must be scheduled in accordance with the Collective Agreement’s long-range extension provisions, the Chief Arbitrator found that where an Article B5 short-range flight leg is permissibly added to such a pairing, the crew rest on layover following that flight leg is governed by Article B5, which provides for only 10-12 hours of rest.

The Collective Agreement still requires Air Canada to comply with strict scheduling rules for long-range extension pairings under Articles B14, L18, and L22.  Further, the circumstances in which Air Canada can add short-range flights to long-range extension pairings remain limited by the Collective Agreement.  The Union will continue to monitor Air Canada’s practices regarding long-range extension pairings and file further grievances as appropriate.

Notice of Upcoming Election – Local Trustee 3-Year Term Position

In accordance with Appendix “C” of the Air Canada Component Bylaws, anyone wishing to be nominated for the available Local Trustee position should adhere to the following information:

A Trustee election shall be held every year. (Article C.3.1.b).

Members who wish to be nominated for the available Local Trustee position shall file nomination papers and a completed Oath of Nomination form, to be received by the Chairperson of the Component Tabulating Committee by February 15th in the calendar year preceding the Local Officer Elections. (Article C.4.1)

Candidates shall disclose their full name and intended position clearly on the nomination papers prior to soliciting signatures. (Article C.4.2)

Nomination forms, as provided by the Component Tabulating Committee, must have signatures from lesser of either: (a) Fifty (50) members of the eligible voters on the Local’s Membership List; or (b) Five (5%) percent of the eligible voters on the Local’s Membership List. (Article C.4.3)

The Oath of Nomination form (Appendix “F”) must be completed in its entirety in order to be accepted by the Tabulating Committee. (Article C.4.4)

* IMPORTANT: Due to the current COVID-19 Pandemic, and on an exceptional basis, the Component Tabulating Committee will accept electronic signatures on nomination forms for the available Local Trustee position.  An electronic signature must be the member’s actual signature and not simply the member’s name typed onto the nomination form. This will allow for members not actively in the workplace to nominate a candidate. The nomination form must be filled out in its entirety by the candidate, signed off and dated prior to scanning for electronically received signatures. We are doing this to ensure all members have an opportunity to run, as well as ensure all members have an opportunity to collect signatures, with the COVID pandemic in place, many of you are not able to access your work sites or Union offices due to not having a RAIC.
