Settlement for Recently Filed Grievance CHQ-21-15

he Union would like to advise that we have reached a settlement for the recently filed grievance regarding managers covering cabin crew over the past weekend.

The general terms of the settlement are as follows:
• It has been agreed that there will be a short crewing premium applied to flights that had managers assigned to them;
• The company will immediately implement a 50% premium for Voluntary Extension for the remainder of the August 2021 block month;
• The Company assures CUPE that additional recalls will be expedited.

Once this settlement was agreed to, the company advised that a further 356 cabin crew are being recalled within the next 48-72 hours.  We will update you with a recall bulletin when we have the final information on this.

We continue to appreciate the reports coming in, so that we may continue to address the reality you are facing with short crewing, capped loads, excessive drafting, and health and safety concerns with the recent high level of cases of COVID positive passengers on board.  We are in discussions with the company on these issues and will advise when we have any further information.

2021 Fiscal Year End
As the fiscal year ends, I am happy to report that the Component was successful in overcoming the many financial challenges that this past year put in place.  ACCEX initially budgeted to run a $200,000 deficit during the year, but with strong cost control measures and continued government assistance through the CEWS program we were able to significantly reduce the size of our deficit.  Some of the adjustments made to the Component’s operation will have long-term cost savings for the Union. I also want to thank the Local Presidents for their assistance and flexibility over the past year.

Statement of Operation – 2021 Fiscal Year (July 2020 – June 2021)
Please see below the Unaudited Statement of Operation for the past fiscal year which ended on June 30, 2021. Our annual accounting audit will take place in January 2021 as per the Component Bylaws.

2022 Component Budget
ACCEX met in late July to review a draft budget for our 2022 fiscal year. We remained conservative in our anticipated dues revenue but did budget for increased funds for our committees compared to last year and set aside funds for the resumptions of the bargaining reopener.   The budget was unanimously approved by ACCEX.

Trustee Audits
Our three Component Trustees are scheduled to resume audit work in September. They will start with finishing off the 2015 year end audit. As part of the 2022 budget, I have allocated a significant amount of funds so that the trustees may continue to work through the backlog of trustee audits. It’s worth noting that our books are audited annually by an external auditor, to ensure the Financial Statements as a whole are free from material misstatement, whether due to fraud or error, and that the Statements are presented in compliance with Canadian Accounting Standards for Not-for-Profit Organizations.

Belfield Update
The Component moved into our offices at 25 Belfield Road in 2006. The Office was heavily renovated at that time and a new roof was installed in May 2006 with a 15-year warranty. There were multiple days of heavy rain in late May and our roof began had a major leak … exactly one week after that 15-year warranty expired. Great timing, eh?  As such we had two different roofing companies provide quotes for repair and replacement. Based on the reports from the different roofing companies, ACCEX decided it was best to go for a forward with a replacement and work began this week.

Unacceptable Staff Shortage – Update and Grievance Filed

As a follow-up to our bulletin, sent on Saturday, regarding IFS Management working flights, we are writing to advise that we have filed grievance CHQ-21-15 – Work of the Bargaining Unit. A copy of the grievance form can be accessed by clicking HERE.

The Union alleges that Air Canada has violated the Collective Agreement by assigning managers to do the work of the bargaining unit. In total 13 pairings were operated by managers over the weekend, in addition to pairings operated by our members on special assignment. This all occurred while over 4,500 bargaining unit members remained on layoff status.

The Union will continue to monitor for management assigned pairings, but encourage members to advise their Union immediately if they are assigned onto your flight. In addition, we continue to monitor short-crewing and drafting and will continue to push for further recalls.

Please remember that if you do have a manager onboard, that they are not permitted to perform onboard service. As per Company policy, any adjustments or deviations from service standards must be documented in an onboard service report (eOBR).

COVID Tracing Update – Effective August 8, 2021

We were informed a short while ago that the employer will be changing their contact tracing decision tree questions. While Air Canada continues to recognize that disclosure of vaccination status is voluntary, one of the first question you will be asked by the contact tracer is whether you have been fully vaccinated. Our understanding is that those who indicate that they are fully vaccinated will be identified to “self-monitor” and will continue flying.

Air Canada’s COVID vaccination policy states that:

“In order for the employer to assess future biosafety measures, all employees who are coming into the workplace are encouraged to notify Air Canada of their Vaccination status.”

Your Union recognizes the important role that vaccination plays in protecting the health and safety of Canadians, and in returning to the new normal. However, we also recognize the sanctity of medical privacy. At this time, a mandatory vaccination policy has not been adopted by our employer, and any disclosure regarding vaccination continues to be voluntary.

We recognize the sensitivity of this topic, and we will continue to support our membership while ensuring Health and Safety remains at the forefront. The purpose of this brief bulletin is to clarify the current employer policy on disclosure of vaccination status. Click HERE for a link to the Policy.
